Terms & conditions of use
TERMS AND CONDITIONS FOR USE OF MERLIN ENTERTAINMENTS GROUP - INTELLECTUAL PROPERTY RIGHTS IN LOGOS, NAMES AND/OR IMAGES
- Merlin Entertainments Group agrees to grant to you a non-exclusive licence to use the logos, names and/or images on the following terms and conditions.
- You acknowledge and agree that all copyright, trade marks and all other intellectual property rights in:
- the logos, names and/or images relating to all or any of the attractions owned by Merlin Entertainments Group known as Alton Towers Resort, LEGOLAND® Windsor , London Eye, Chessington World of Adventures & Zoo, THORPE PARK, Madame Tussauds, the Dungeons, Warwick Castle; SEA LIFE centres and Seal Sanctuaries.
- the images relating to the attraction partly owned and operated by Merlin Entertainments Group known as London Eye are owned by or licensed to Merlin Entertainments Group ("IPRs").
- You acknowledge that when creating any material (including but not being limited to newsletters, magazines, brochures and/or websites) using the IPRs ("the Materials") to promote all or any of Alton Towers Resort, Chessington World of Adventures & Zoo, THORPE PARK, LEGOLAND® Windsor, the Dungeons, SEA LIFE centres , Seal Sanctuaries., Madame Tussauds, Warwick Castle and London Eye ("the Attractions") you agree, at your own cost to:
- produce designs, layouts and artwork for and print all Materials;
- feature on the Materials such details as Merlin Entertainments Group shall request;
- send samples of Materials to Merlin Entertainments Group for its approval;
- make reasonable amendments (if appropriate) following submission of the Materials for approval before the Materials are distributed to members of the public.
- You agree to send all samples of Materials by:
- post to "Trade Marketing Department, The Merlin Entertainments Group, Silverglade, Leatherhead Road, Chessington, Surrey, KT9 2QL"; or
- e-mail as a pdf file to your account manager, who in turn will forward this to the Marketing Department
- Merlin Entertainments Group shall supply its approval (or the reasons for the refusal of approval) in writing to you no later than 48 hours after receipt of the Materials.
- You acknowledge that you cannot request or allow any third party to use the IPRs in any way unless Merlin Entertainments Group has first agreed to this.
- You agree to assist Merlin Entertainments Group in protecting the IPRs and shall not knowingly do or cause or permit anything to be done which may endanger the IPRs or Merlin Entertainments Group' title to them.
- You agree that you shall not act or use any of the rights or licences granted to you by these terms and conditions in a manner which is prejudicial to or defamatory of Merlin Entertainments Group or of theme parks and/or exhibitions generally.
- You acknowledge and shall ensure that:
- the Materials which are surplus to requirements are properly, safely and securely disposed of; and
- proper and adequate measures are in force at the premises of any third party where Materials are designed, printed or stored
